1. Acceptance

By using CUE321 (the "Software") you agree to these Terms. If you do not agree, do not use the Software.

2. Description

CUE321 is a browser-based professional media playout tool for live event and broadcast production. Core functionality operates entirely within your browser using local files. No account is required.

3. Licence & Use

• CUE321 is provided free of charge for personal and commercial broadcast use.
• You may not resell, rebrand, or redistribute CUE321 as your own product without written permission from CUE321.com.
• You are solely responsible for ensuring you hold all necessary rights and licences for media content you broadcast through the Software.

4. No Warranty

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. CUE321.COM DOES NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION. BROADCAST USE IS AT YOUR OWN RISK.

5. Limitation of Liability

To the maximum extent permitted by Ontario law, including the Consumer Protection Act, 2002 (Ontario), CUE321.com shall not be liable for any indirect, incidental, consequential, or special damages arising from use of the Software, including broadcast failures, loss of revenue, or data loss.

6. Voluntary Donations

Donations of $17 CAD (or any amount) are entirely voluntary and non-refundable. They support continued development of CUE321. Payments are processed by a third-party payment provider subject to their terms. CUE321.com does not store payment card information.

7. Media Content

You are solely responsible for compliance with the Broadcasting Act (Canada), Copyright Act (Canada), CRTC regulations, and any applicable broadcast licensing requirements for all media you distribute using CUE321.

8. Intellectual Property

The CUE321 name, logo, design, and code are the intellectual property of CUE321.com. Media you load remains your property.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved in the courts of Ontario.

10. Changes

CUE321.com may update these Terms. Continued use after changes constitutes acceptance. Current Terms are always available within the Software.

Data We Do Not Collect

CUE321 does not transmit your personal information, media files, or playlist contents to any server. The Software runs in your browser and all processing is local.

Data Your Browser May Transmit

Like all web pages, when you load CUE321, standard browser and network operations may transmit connection metadata to web servers involved in serving the page. This can include your IP address, browser type, and referring URL. This information is handled in accordance with your browser's and network provider's standard practices and is not collected or stored by CUE321.com beyond what is required for normal server operation and security.

Local Storage (Optional)

If you click "Accept & Save," CUE321 stores the following in your browser's localStorage:

• Output settings (resolution, LED panel configuration, standby preferences)
• Playlist metadata (file names and types — not the media files themselves)
• Application preferences (crossfade settings, loop state)
• Your cookie consent choice

This data never leaves your device through CUE321. If you choose "Session Only," no data persists beyond your current browser session.

Media Files

Media files you add are accessed via browser Blob URLs local to your device. They are not uploaded or transmitted through CUE321.

Third-Party Services

Google Fonts are loaded from Google's servers when you open CUE321, which may involve transmission of your IP address to Google. If you use the Donate button, payment is processed by Stripe, subject to Stripe's privacy policy. CUE321.com receives confirmation of payment only.

Analytics & Advertising

CUE321 does not use analytics services, advertising networks, or tracking cookies.

Your Rights Under PIPEDA

You have the right to access, correct, and request deletion of any personal information CUE321.com holds about you. Since we collect minimal information (primarily through server logs), most requests will confirm that no personal information is held. Contact: privacy@cue321.com

This Policy may be updated. The current version is always available within the Software.
